FLOATME MVP REWARDS PROGRAM SWEEPSTAKES
OFFICIAL RULES

The MVP Rewards Program (the “Program”) is a sweepstakes offered byFloatMe, Corp. (“FloatMe,” “we,” “us,” or “our”). The Program allows you to obtain free entries (“Entry” or “Entries”) into a monthly drawing for the chance to win prizes in the form of a check or, for those with an MVP Card (the “Card”)a deposit into the deposit account associated with your Card (“SecuredAccount”). These FloatMe MVP Rewards Program Sweepstakes Official Rules(the “Rules”) govern your participation in the Program. We may modify, suspend, or terminate the Program and these Rules at any time at our discretion. Any changes we make will be effective upon posting to our website and mobile application. The Program and Rules are subject to all applicable federal, state, and local laws and regulations, and are void where prohibited.
FloatMe is a financial technology company and not a bank or lender. TheCard is issued by Evolve Bank & Trust (the “Bank”), member FDIC, pursuant to a license from MasterCard. This Program is provided to you by FloatMe and isn ot sponsored by the Bank. The Bank is not a party to these Rules and has no obligations, liability or other responsibility for the Program, including but not limited to, the servicing, management or administration of the Program or any payment of any reward or prizes earned under the Program or theseRules.
1. Eligibility
The Program is open to U.S. citizens or legal permanent residents, reside within the 50 United States, the District of Columbia, or a U.S. territory, and are at least 18 years old. Proof of residency and age may be required. Employees, directors and officers of FloatMe or its parents, subsidiaries, or affiliates, as well as the directors and officers of any advertising or sweepstakes agencies used by FloatMe in connection with the Program are ineligible to participate in the Program.
You must also agree to comply with and be bound by these Rules to participate in the Program, and, by entering, you represent and warrant that you agree to be bound by these Rules and the decisions of FloatMe, whose decisions shall be binding and final in all respects relating to this Program.
2. Timing of Drawings
Potential winners will be randomly selected monthly and will be drawn from all Entries received from eligible sweepstakes participants (“Participants”)during the month ending 60 days prior to the drawing (“Entry Period”). EachEntry Period will begin at 12:00:00 PM Central Time on the first day of the month and end at 11:59:59 PM Central Time on the last day of the month.Drawings will occur during the first week of each month until the Program is terminated or modified. For example, for an Entry Period beginning on January1, 2023, and ending January 31, 2023, potential winners would be selected from those Entries during the first week of April 2023.
The first drawing under the Program will occur the first week of [month/year]and continue each month until the Program is terminated or modified. SeeSection 5 below for information about how we notify potential winners and how to claim prizes.
3. How to Enter
To participate in the Sweepstakes, you must submit Entries. Entries are free and can be submitted in multiple ways. Each Entry has an equal chance of winning regardless of how the Entry was submitted. You may submit Entries by:
1. Using your Card to make Purchases. If you are a Cardholder, every$10 you spend on an eligible purchase at a merchant using yourCard, one Entry will automatically be submitted. An “eligible purchase” is a purchase transaction using your Card for goods or services. Eligible purchases do not include balance transfers, ATM transactions, fees (whether charged by us, the Bank, or any other party), cash advances or cash-like transactions. Eligible purchases also do not include purchases prohibited or not otherwise permitted under your cardholder agreement with the Bank. The number ofEntries submitted through purchases will be calculated by totalling all eligible purchases that settled (i.e., are not pending transactions)during the relevant Entry Period, subtracting all returns, refunds, or other credits made by merchants during the month, dividing the remaining total by 10, and rounding the result down to a whole number.
2. Participating in periodic promotions. From time to time, we may offer promotions that allow you to submit Entries by other means, such as by performing certain actions or engaging in certain activities related to the Card, our mobile application, or our other products and services. We will disclose these promotions to you through our mobile application.
3. Mailing Entries. You can submit Entries at any time without being aCardholder, using a Card, or participating in a promotion by mailing us a letter containing the following information: (a) your full name,(b) your mailing address, (c) if applicable, the account number associated with your Card, (d) and a valid email address(Cardholders must use the email address associated with theirCard). Each letter must (1) have all required information; (2) be signed by hand; and (3) mailed in an envelope to 110 E Houston St, 7th floor, San Antonio, TX 78205. Only one letter may be included per envelope, and each letter received by us will result in the submission of one Entry. We reserve the right to reject any letter that does not conform to these requirements.
There is no cap on the number of Entries you can submit. However, use of any automated system to enter is prohibited and will result in disqualification. We are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Entries, all of which will be ineligible to win a prize.
4. Prizes and Odds
Multiple prizes of varying amounts will be available each drawing. ForCardholders, prizes will be given in the form of a deposit into your SecuredAccount. If you are not a Cardholder or you are unable to receive a deposit into your Secured Account, prizes will be paid in the form of a check mailed to the address provided with your Entries. Each Participant may only win one prize per drawing. The prize amounts available during each drawing will be$5,000, $1,000, $500, and $100. The number of potential winners of each prize amount will differ based on the total amount of funds available (“Prize Pool”)for each drawing. The size of the Prize Pool for each drawing is determined by the total purchase activity across all Cardholders during the applicable EntryPeriod. The Prize Pool is then divided by four and an equal amount is allocated to each prize amount. If the amount allocated to a prize amount cannot be divided evenly by that prize amount, then the remaining funds will be added to the funds allocated to the next highest prize amount. Any funds remaining after all prize amount allocations are finalized will be added to the Prize Pool for the next drawing.
For example, if the Prize Pool for a particular drawing is $42,000, then $10,500will be allocated to each prize amount. Each allocation would then be divided by the applicable prize amount to determine the number of prizes of that amount that will be available, resulting in: (a) two prizes of $5,000 from the$10,500 allocation with the remaining $500 reallocated to the amount designated for the next highest prize amount; (b) 11 prizes of $1,000 from the initial $10,500 allocation and the additional $500; (c) 21 prizes of $500; and (d)105 prizes of $100. All available prizes will be awarded each drawing. Your odds of winning a prize will not be known before each drawing, as the odds will depend on the size of the Prize Pool, the number of Participants participating in the Program, the number of Entries each Participant submits during eachEntry Period, and the number of Entries submitted by each potential winner selected.
We reserve the right to change these prizes at any time at our discretion. You can only win a prize if one of your Entries is selected during a drawing. THERE IS NO PURCHASE NECESSARY TO SUBMIT ENTRIES OR WIN A PRIZE, ANDAN ENTRY OBTAINED THROUGH THE USE OF YOUR CARD AND AN ENTRY OBTAINED THROUGH ANY OTHER MEANS HAS AN EQUAL CHANCE OF WINNING.
5. Notification and Disbursement of Prizes
If you are selected during a drawing as a potential winner of a prize, you will be notified via email provided with the Entry or on file with FloatMe, and if applicable push notification through the FloatMe mobile application installed on your phone. You do not need to respond to the notice or take any other action to claim your prize. Prizes will be deposited into your Secured Account(or, if you are not a Cardholder, a check will be mailed to you) within 5business days after you are provided with notice. However, if you do not wish to receive (or cannot receive) a prize awarded to you, you must respond to the notice in writing by emailing us at support@floatme.com and indicate that you reject the prize.
Winning a prize is contingent upon fulfilling all requirements set forth in theseOfficial Rules. In the event a potential winner (a) declines or cannot accept, receive or use the prize for any reason; (b) is found to be ineligible to participate in the Program or receive a prize before the prize is disbursed; or(c) otherwise cannot or does not comply with these Rules, the potential winner shall be disqualified and an alternative winner will be selected. We reserve the right to modify the notification in connection with the selection of alternate potential winners, if any.
6. Publicity
Except where prohibited or restricted by law, your acceptance of a prize constitutes your agreement and consent for us to use and/or publish your name, city and state of residence, the prize you were awarded, and/or any statements made by you regarding the Program or FloatMe, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of FloatMe, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or the internet, without further limitation, restriction, compensation, notice, review, or approval. 7. Winner List
For the names of the winners, mail a written request to FloatMe, 110 E HoustonSt, 7th Floor, San Antonio, TX 78205.
8. Opting Out of the Program
If you do not want to participate in the Program for any reason, please email us at support@floatme.com or write to us at 110 E Houston St, 7th Floor, SanAntonio Texas 78205. Be sure to include your (a) full name; (b) phone number; and (c) the e-mail address associated with either your Card or theEntry or Entries you have mailed to us.
9. General Conditions
FloatMe and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors (“ReleasedParties) shall not have any obligation or responsibility, including any responsibility to award any prize to Participants, with regard to: (a) Entries that contain inaccurate information or do not comply with or violate theseRules; (b) Entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) Participants who have committed fraud or deception in entering or participating in the Program or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of a winner to accept the prize for any reason; (f) if a prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond our reasonable control; or (g) any damages, injuries or losses of any kind caused by any prize, the publication of information under Sections 6 or 7 of theseRules, or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this Program or any promotion or prize related activities. FloatMe reserves the right, in its sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Program, or with any website or mobile application promoting the Program or (b) acting in violation of the Rules. IfFloatMe determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Program, it reserves the right to void the Entries at issue, and/or terminate the relevant portion of the Program, including the entire Program, and/or modify theProgram and/or award the prize from all eligible Entries received as of the termination date.
10. Limitations of Liability
The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by Participants, printing errors or by any of the equipment or programming associated with or utilized in the Program; (b)technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Program; (d) technical or human error in the administration of the Program or the processing of Entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Program, receipt or use or misuse of any prize, or FloatMe’s publication of winners’ information pursuant toSections 6 and 7. If for any reason one or more of a Participant’s Entries are confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the Participant’s sole remedy is another Entry in the Program.

12. Disputes
You, the Participant, agree that any and all disputes, claims and causes of action arising out of or connected with this Program, or any prizes awarded, shall be resolved by binding arbitration and class action waiver in accordance with our general Terms and Conditions.
